Terms of Service
The agreement between you and Qadouratechsolutions Ltd, trading as ATS Hiring, for using our hiring and résumé services.
Last Updated:
1. Who we are, and what these terms cover
ATS Hiring is operated by Qadouratechsolutions Ltd (company number 17192366), registered office 20 Wenlock Road, London, N1 7GU, United Kingdom, trading as ATS Hiring — "we", "us" and "our" in this document. These terms are the agreement between you and us, and you accept them when you create an account or use the service. The platform has two sides. If you check or build a résumé, or apply for a job, you are a candidate — you can do this with an account or as a guest. If you sign up to publish jobs, receive applications and manage applicants, you are an employer; that includes in-house recruiters, agencies and anyone hiring on someone else's behalf, and the company account you work in is your workspace. "The service" means the ATS Hiring website, apps and APIs. "Candidate data" means information about a candidate, including their name, contact details, application answers and CV. Where a section says it applies to employers or to candidates, it applies only to that side.
2. Accounts, workspaces, seats and roles
Who can use ATS Hiring. You must be at least 16 years old to create an account or use the service, including as a guest. If you are under 18, you confirm that a parent or guardian has read these terms and agrees to them on your behalf. If you use the service as an employer or recruiter, you must be an adult (18 or over) acting for your organisation and authorised to do so. You must give accurate details when you register, keep your password to yourself, and tell us if someone else uses your account. You are responsible for what happens under your account. An employer account belongs to a workspace, which represents your company. The person who creates the workspace owns it, and the owner's subscription is the workspace's plan: seats, limits and quotas belong to the workspace and are shared by everyone in it, not counted separately for each member. Owners and admins can invite people, give them a role, and remove them. Every member who has access to the workspace can open the applications the workspace receives and see the candidate's contact details and CV, whatever their role — including members who are added after an application arrived. The owner decides who has access, must remove access when someone no longer needs it, and is responsible for what the workspace's members do. We keep a record of membership changes in the workspace, such as invitations, joins, role changes and removals. We do not keep a record of which member opened which application, so we cannot tell you who inside a company viewed a particular candidate.
3. Employer obligations for candidate data
If you use ATS Hiring to receive job applications, you agree that: you will use candidate information only to assess candidates for roles at your organisation; you will give workspace access only to people who need it for that purpose and will remove their access when they no longer do; you will not sell candidate information, or pass it to anyone outside your organisation, without the candidate's consent; you will keep any data you export from the platform secure and will delete it when you no longer need it; and you will respond to candidates who contact you about their data. If you upload CVs you already hold, you confirm you have the right to do so and that you have told those people how you use their data; we store them as applications in your workspace and process them on your behalf. You are responsible for your organisation's use of candidate information, including use by the people you give access to. You must also have a lawful basis for the recruitment you carry out, tell candidates what you do with their data where the law requires it, and follow employment and discrimination law in the countries you hire in.
3b. Data Processing Terms (employers)
This section applies where we process candidate data on your behalf and forms part of these terms. For the applications your workspace receives, you are the controller of that candidate data and we are your processor under UK data protection law. We will: process candidate data only on your documented instructions — your and your members' use of the service is such an instruction — and as otherwise required by law, telling you first unless the law forbids it; make sure the people we authorise to process it are bound by confidentiality; apply appropriate technical and organisational security measures; use sub-processors under each provider's data-processing terms, keep the current list published in our Privacy Policy, and tell you before we add or replace one so that you can object; help you respond to candidates exercising their data protection rights, and help you with security, breach notification, impact assessments and prior consultation, taking into account the nature of the processing and what is available to us; tell you without undue delay after we become aware of a personal data breach affecting your candidate data; on the ending of your account, delete or return your candidate data as described in section 9 except where we must keep it by law; and give you the information you reasonably need to show that we meet these obligations. Transfers outside the United Kingdom are described in our Privacy Policy. These terms apply in place of any data processing agreement you send us unless we have signed that agreement.
4. Acceptable use
You agree not to: publish a job that does not exist, or that is misleading about the role, the pay or who the employer is, or that exists mainly to collect CVs and contact details; ask candidates for payment, bank details or identity documents through the service; send unsolicited marketing or spam through the service; harvest, scrape or bulk-collect candidate profiles, CVs or contact details, by hand or by any automated means; use the service to build a competing product, resell access to it, or operate it for a third party without our written agreement; reverse engineer, decompile or try to extract our source code or models; upload malware, try to defeat our access controls, or test our security without our written permission; upload content you do not have the right to upload; impersonate another person or company; or use the service for unlawful discrimination or any other unlawful purpose. We may investigate, suspend or close an account that breaks these rules, and we may remove a job posting without notice.
5. AI results are decision support, not decisions
We use AI to read CVs, job descriptions and application answers, to extract structured details, to produce scores and reports, and to suggest matches. These results are decision support, not decisions. They are always shown to a person — you, or the employer's team — and the platform never rejects an applicant automatically. Scores, extracted details and suggestions are estimates and can be wrong or incomplete. If you are an employer, you must not treat a score as the only reason to reject a candidate, and you remain responsible for your hiring decisions and for following employment and discrimination law. If you are a candidate, a score is feedback on a document, not a prediction of whether you will be hired. Our AI Processing Notice explains what we send, who receives it and what choices you have.
6. Employer verification and applications
We check employers before and while they use the service. We may ask an employer to prove control of a company email domain, or to give other evidence that the company and the role are real, and we may review, restrict, suspend or remove an employer, a workspace or a job that fails those checks or that we reasonably believe is misleading. We may require an employer to complete verification before its jobs can be published, before it can reveal a candidate's contact details, or before it can receive applications; where verification is required in order to receive applications, applications sent to that employer may be held until verification is complete or the job closes. These checks reduce risk, they do not remove it: we do not promise that any employer is genuine, solvent, or that it will reply to you, and we are not a party to the hiring relationship between a candidate and an employer.
7. Plans, trials, payment, renewal, refunds
Parts of the service are free. Paid plans are subscriptions sold monthly or yearly and paid through Stripe; we never see or store your card number. A monthly subscription is charged each month and renews each month until you cancel. A yearly subscription is prepaid for twelve months at the discounted yearly rate and renews each year until you cancel. Prices are shown before you buy and are exclusive of any taxes that apply where you are. Seats, limits and quotas belong to the workspace and are shared by its members; where a plan meters usage beyond what it includes, we show the usage and the price before it is charged, and we do not make silent charges. Enterprise is not sold self-serve — it is agreed with us in writing. A recruiter trial runs for 3 days, needs a card, and charges nothing until it ends; it applies to whichever interval you chose, and you can cancel it in the billing portal before it ends and pay nothing. If you upgrade in the middle of a period, the change is prorated. You can cancel at any time in the billing portal and the cancellation takes effect at the end of the period you have already paid for. We do not refund a period that has started, and we do not refund a yearly subscription pro rata: if you cancel a yearly plan you keep access until the end of the paid year, and if you cancel a monthly plan you keep access until the end of that month. In both cases your workspace then moves to the free plan and keeps its data under the free plan's limits. Nothing in this section removes a refund the law requires us to give. If you are a consumer buying a one-off product such as the Fix Kit, you normally have 14 days to change your mind under UK law. Because we deliver it immediately, by completing the purchase you ask us to deliver it straight away and acknowledge that you lose that right once delivery has begun. We may change prices, and we will tell you by email before a change applies to your renewal so that you can cancel first. We may show you an upcoming-renewal notice in the app; your invoices are available in the billing portal.
8. Availability, warranties, liability and indemnity
We work to keep the service available, but we do not promise it will be uninterrupted or free of errors, and we may change, suspend or withdraw features. The service is provided "as is" and, so far as the law allows, we exclude all implied warranties, including any implied warranty of merchantability, fitness for a particular purpose and non-infringement. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Subject to that, we are not liable for loss of profit, loss of business, loss of goodwill, loss of data, or any indirect or consequential loss, and our total liability to you in connection with the service is limited to the fees you paid us in the twelve months before the event that gave rise to the claim. If you are an employer, you will indemnify us against claims, losses, damages and reasonable costs arising from your use of candidate data in breach of these terms or of data protection law, including use by the people you give access to your workspace. If you are a consumer, this section does not affect your statutory rights.
9. Ending your account, and what happens to your data
You can stop using the service at any time, and you can delete your account in Settings; deletion is immediate and cannot be undone. If you own a company workspace that has other members, you will not be able to delete your account until that is resolved — write to us and we will help. When a subscription ends or is cancelled, your account and workspace stay active on the free plan and the data in your workspace (jobs, applications, candidate records and settings) is kept and remains available to you under the free plan's limits; we do not delete workspace data on cancellation. As the owner you can delete a workspace yourself from your companies page; this deactivates it immediately for every member but does not erase its data. To have the data erased, write to [email protected] from the owner's registered address; we will verify that you are the owner, erase it within 30 days, and confirm when it is done. Deleting a candidate account does not delete the applications that candidate has already sent: we anonymise them by removing the candidate's name, contact details, answers and CV, and a record that an application existed remains with the employer, because the employer needs it for its own hiring record. Our Data Retention and Deletion page sets out the retention rules for the data most people ask about. We may suspend or close an account that breaks these terms, does not pay, or that we are required to close by law. Sections 3, 3b, 4, 8, 9 and 10 continue to apply after this agreement ends. Our database provider keeps backups for a limited period for disaster recovery only; they are not used to restore deleted data, and uploaded files are not part of those backups.
10. Governing law, courts, entity and language
ATS Hiring is operated by Qadouratechsolutions Ltd, a private company limited by shares registered in England and Wales under company number 17192366, whose registered office is 20 Wenlock Road, London, N1 7GU, United Kingdom. These terms, and any dispute or claim arising out of them or their subject matter, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer, you may also bring proceedings in the courts of the country where you live, and the mandatory consumer protection rules of that country continue to apply to you. These terms are published in English and in Arabic. The Arabic version is provided for convenience; if the two differ, the English version governs.
11. Changes to these terms
We may change these terms, the Privacy Policy and the AI Processing Notice. When a change affects what we promise, we publish a new version with a new effective date and ask you to accept it the next time you use your account: you will be shown the new documents and will not be able to continue until you accept them. If you would rather not accept, you can stop using the service and delete your account. Corrections that do not change what we promise — typographical fixes, clearer wording, or a sub-processor change already covered by the Privacy Policy — may be published without asking you to accept again.
